Hernia can be considered as among the smallest but downright complicated bane that we have been forced to face. Of course, not all people get hernia but those who do suffer greatly from it – intense pain, induced complications, difficulty in bowel movement and the list goes on and on and on. Simply put, hernia is one pain in the ass. Some people would even just wait for the pain to pass or take pain relievers. This can prove to be effective in the short run, but not that all efficient as time passes by.
Meanwhile, medical companies have sought to provide relief (and at the most optimum level, total cure) to the people living with hernia. Of course, hernia is a very broad term and as such, there are quite varying cases for different people. Thanks to an outpour of resources and medical knowledge, more and more cure/relief for hernia has been introduced to us, one of which is the hernia mesh patches.
Among the many hernia patches is the famous Bard Composix Kugel Mesh Patch. Unfortunately, it wasn’t actually all rainbows and butterflies for its patients. After a while, these mesh patches proved to be defective, with the vital “memory coil ring” eventually breaking, either by the stress of its placement or by daily wear and tear – this then resulted to the bard hernia mesh recall, one of the most shocking defective medical device recall that ended in an estimated 184 million-dollar (and counting!) lawsuit for its distributor, C. R. Bard.
The hernia mesh recall became a warning of some sorts for medical companies that research and manufacture medical devices. Of course, it is standard procedure that these medical devices pass the strict guidelines of the US Food and Drug Administration (US FDA) before it becomes readily available for hospitals and patients to purchase. However, some medical devices (like these hernia mesh patches) experience defects at the middle stages. To control such a situation, the US FDA then issues a recall, if the manufacturer still haven’t halted distribution.
Indeed, filing their kugel hernia mesh lawsuit is one proper and necessary recourse that people with the defective medical device implants can do. Surely, there’s bound to be damage to these patients, may it be financially, emotionally, or physiologically. With the settlement from a successful lawsuit, patients can hope to recover from such an unfortunate experience with all the help (and resources) they can get. As such, the secret to the entirety of the lawsuit is to find that one legal firm that’s going to back you up, by hook or by crook.
